The collaborative law process is a means of resolving divorce and child custody issues without litigation. It is a new but growing practice based on three principles: 1) a pledge not to go to court, 2) an honest exchange of information by both spouses, and 3) a solution that takes into account the highest priorities of both spouses and their children. A divorce and custody solution is achieved through a series of respectful meetings between both spouses and their lawyers, rather than a series of court hearings which typically result in more anger. In the collaborative process, lawyers work with each other rather than against each other, and they also work with other professionals, such as counselors or financial consultants, when needed.
